Please read these Terms and Conditions carefully before using the Blissmal platform or services. By accessing or using our platform, you agree to be bound by these terms. If you do not agree, please do not use our services.
These terms apply to all visitors, users, merchants, and customers of Blissmal. For questions or inquiries, please contact us.
Use of the Platform
Eligibility
You must be at least 18 years old to create an account and subscribe or place orders on Blissmal. By using the platform, you confirm that you meet this requirement and that the information you provide is accurate.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials. Any activity that occurs under your account is your responsibility. Notify us immediately if you suspect unauthorized access.
Prohibited Use
You may not use this platform for any unlawful purpose, to submit fraudulent transactions, to impersonate another person, or to attempt to gain unauthorized access to any part of our systems or networks.
Subscriptions, Orders & Payments
Order & Plan Acceptance
Subscribing to a plan or placing an order constitutes an offer to purchase. We reserve the right to accept or decline any transaction at our discretion — for example, due to plan availability, pricing errors, or suspected misuse.
Pricing
All pricing rates are displayed in Kenyan Shillings (KES) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to correct pricing errors, even after a transaction has been initiated.
Payment Processing
Payment is processed via Safaricom M-Pesa STK Push. Your subscription or order is activated/confirmed only once payment is successfully verified. Failed payments will prevent service activation.
Platform Deliverables & SLAs
Service Availability & SLA
We strive to maintain high platform availability (99.9% uptime). However, we are not liable for service interruptions caused by third-party service provider network failures, Safaricom M-Pesa gateway downtime, or maintenance windows.
Store Deliveries (for Storefronts)
Store owners are solely responsible for coordinating delivery timelines and fulfilling product shipments to their customers. We are not a party to the delivery transactions between merchants and buyers.
Intellectual Property
Our Content
All content on this platform — including text, logos, software, layout design, and branding — is owned by or licensed to Blissmal. You may not reproduce or distribute any of our property without express written permission.
Merchant Content
Merchants retain full ownership of all logos, product listings, and media uploaded to their storefronts. By uploading, you grant us the license to host and display this content to operate your store.
Limitation of Liability
No Warranty
Blissmal is provided "as is" and "as available". We make no warranties that the platform will meet all your requirements or operate completely error-free.
Indirect Damages
To the maximum extent permitted by law, Blissmal shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits, data, or business opportunity) arising from your use of the platform.
Maximum Liability
Our total liability to you for any claim arising out of these terms or platform usage shall not exceed the amount paid by you to us in the 3 months preceding the claim.
Termination
Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, fail to settle subscription balances, or behave in a manner harmful to other users or our platform.
Refunds on Termination
Upon termination of a merchant store due to a violation of terms, any subscription fees paid are non-refundable. All store pages and database references will be deactivated.
Governing Law & Changes
Governing Law
These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kenya.
Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes via email or dashboard announcement. Continued use of the platform after updates constitutes your acceptance of the revised Terms.
